The FCRA refers to the Fair Credit Reporting Act. It includes a set of rules which are required to be followed by the lenders or creditors, and also by the agencies. They ensure that the creditors or lenders don’t harass some borrowers and therefore, these rules are in place by the government.
First thing is the reporting. Inaccurate reporting causes problems for borrowers, and sometimes they don’t know how to handle it. This responsibility is given to the creditors or lenders. It is their responsibility to make sure that the borrowers don’t get into problems due to inaccurate reporting.
In case a lender denies a loan, modifications due to credit report, or details which the lender came across through an agency, it must provide in written to the borrower the information that caused this denial. Also, it must give in written that the borrower or the consumer can obtain a free copy of the credit information through the agency. The copy must be obtained within 60 days of the request, and the agency and the lender must make sure that the copy is provided to the borrower.
A lender or creditor shouldn’t report any information that he thinks, or he has a reason to believe, is false. He must ensure that the information is correct before reporting it to the agencies. Also, if there is any incorrect information reported, it is the lenders or the borrower’s duty to check it and get it corrected, or help the consumer in correcting it.
The agencies or credit bureaus also have a responsibility. In case a consumer asks for confirmation of some entry on the credit report, the bureau must make sure that it checks whether the information is correct or not, and also, must reply as soon as it can. In case it exceeds a time period of 30 days from the date of request, the entry would be considered false, and will be removed as per rule.
There are a few sets of penalties on not following the FCRA. Actual damages are payable, and also an amount of $100 to $1000 for every violation of the act. Punitive damages may be awarded by the judge. Lawyer fees and cost of the overall hearing is provided to the consumers as per rule.
